This settlement affects over a million NAR members—yes, that includes me—as well as numerous real estate associations and brokerages with annual transactions up to $2 billion. What does this mean? Essentially, a huge chunk of the real estate community is now free from the legal claims that have been hanging over our heads. It’s a big win for stability and focus in our industry.
Changes to MLS Practices
Starting in mid-July 2024, the way commissions are discussed and handled is getting a makeover. We’ll no longer list buyer agent commissions in the MLS. Instead, these will need to be worked out directly, which aims to increase transparency and ensure fairness in negotiations. Plus, agents working with buyers will need to lock in a written agreement before starting the house hunting process. This step is all about clarity—ensuring buyers know exactly what services they’ll get and what they’ll pay.
What About the Big Brokerages?
For those ultra-large brokerages handling more than $2 billion a year, they aren’t automatically covered by this settlement. However, there’s a pathway laid out for them to opt-in, should they choose to seek a similar release.
